So my Silverback got a thorn in its paw today that is called a red Mazda 3. If there is any advice on how to make sure her insurance company pays for all parts, stock and aftermarket please let me know.

So this happened today. I slowed down due to the cars in front of me slowing down. and all of a sudden the wonderful sound of tires being locked up and me being rear ended. I guess she tried to switch lanes to avoid me and made contact with the passenger side rear tire. Turned me sideways and scrapped all the way down to the front tire where I also have paint.


Still investigating what all is damaged. But the list so far is Body panels scrapped up and slightly dented. Both rear tires are wobbling and the rear diff is making some wonderful sounds.

Looks like you got hit at the rear tire?

As they hit you (I HOPE) their insurance pretty much has to cover the damage, even to aftermarket stuff, etc.

If you're at fault, then, it depends on what you told them your rig included, etc...before hand/when premiums were due, etc.


I've been rear ended too many times, and a lot will come down to how cooperative their insurance is as far as fighting you on the value of the damaged mods, etc. Most just require that you use a licensed repair facility to do the work, and they'll pay them for it. Some get *****y about the time it takes to repair things relative to a rental car, as in "A bumper allowance is 2 days, so we'll only pay for 2 days of rental car for the repair"

And I'll be claiming "But it happened Xmas weekend, and the shops were closed, followed by New Years, so it took 4 days to get an estimate, 3 days to get the parts and 1 day to install them, so a week of rental was needed", and so forth.

They are fully at fault, from the cops, and there insurance company has said so. I don't have to worry about the car rental as I have a company truck.

Her license plate is a dead giveaway that she doesn't need to be driving.

I saw that too and started laughing. I think the cop figured out why too.

strong license plate to driving skill ratio lol. Ive been rear ended and bumped from the side from so many women :( With her obviously at fault you should be set to go. Make sure ALL the problems get fixed.

Not sure about your stare laws regarding insurance repairs, but here once there is an official quote from a shop or an insurance estimate, they can write you a check for the repairs to do with as you please. That is my preference for all accidents and claims I was not responsible for.

So my insurance adjuster said basically $2700 for the body damage the mechanical damage is still being investigated. What are all your thoughts on this value? I am waiting for theres to take a look tomorrow. It sucks that I can't take it to a body shop to get my own estimate.

I know every states laws are different but definitely get an estimate of your own you can go back to them with if its higher. I know in SC you get your choice of who does the work. Hopefully the mechanical's aren't too bad, guess you could always push for new axle, locker, and gears if it is.

Well I got there estimate for just the body parts. This includes sliders, Front fender fix, Both passenger door fix, rocker pannel fix, right corner panel fix, backup light, rear corner panel. There pricing is $2889.08 I think this is a fair price.

Still have to hear back about the mechanics which I have a feeling will be new rear axle and gears... Also on this quote will be two new tires and a wheel. <= This stuff I might not replace depending on if the wheel is bent as of right now it just looks like bad curb rash. This will be a different check but that one I need to repair.

I think this is a fair price as I have no care about repairing this stuff and was going to just bed-line the lower section of the door. Like Mr. Chris Haynes did.

Any opinions on this? I'm trying to be fair about this stuff, but I want to make sure I get reimburse for the damage that was done for the lost in value on the vehicle for repairs If I decided to do it in the future.

Remember though.. Just because you want to be fair about these things doesn't mean they want to treat you the same

Just make sure that you have all bases covered and you disclosed all the things that got damaged. Once insurance pays, it is hard to get more money if things are found later.

When I got in my motorcycle wreck, I had a $20k check deposited in my account within 3 weeks. They were just happy I didn't sue...but I was also injured, too, so that's a little different.

^ I was just happy that she and I were both ok, I was not even worried about my vehicle until after I left the scene. They already wrote me a check for the body damage but I don't need to or am going to cash it until the mechanics are worked out. I don't want them to be confused that they already made a payment type of stuff.

I learned a lot about this stuff when I got into both of my motorcycle wrecks. Since one was me being stupid and the other was hit and run it all came down to my insurance and me so dealing with someone else's is kinda different. I was injured in the hit and run but was to prideful to go to the hospital so now I don't just have two bad knees I have 1 bad one and one that detects weather.

Bed lining the body panels to hide a few scuffs look real nice amd is cheap but if you get in another collision the insurance company will not fork out more money because it was never properly repaired.

That is why when I do bed line the body panels I'm going to do before and after. Also they won't pay if it is minor again like this one. But if I get T-boned they would.

So I got the preliminary mechanical issues list. Both axle shafts. Brake caliper, brake pads. They want to repair the wheel even though it is more expensive then replacing it. And a few other minor things. Even though I can do the work myself. I'm thinking I will let them. That way if there are any issues down the road I can blame them for it.

I have no issue doing the work and don't consider it a headache at all. If I did this myself while off-roading I would easily do the work time is money and there are a lot worst ways to spend a weekend.

Derek sorry I didn't see this sooner. pm me if you have any more questions. I am particularly confused by their decision to "repair" your wheel. Not even sure what that entails with rash on a pro-comp. Couple questions. 1) who is the "them" doing repairs? Independent shop? Insurance co. captive shop? 2) Were you ever afforded the opportunity for a second opinion?
Since you live in La, which is quite unique among the 50 states, from a legal standpoint, I hesitate to make sweeping legal statements about your rights. But, I can look into specific things and give you the answers you need. From what I have read you appear to be going about it the right way. Just make sure you don't sign anything that purports to close out your rights to further repairs as might be discovered as warranted.

The repair on the wheel is due to that wheel not being made anymore. I had to correct them on that. A third party reputable wheel shop was going to clean it up and get it re powder coated. Then make sure they can get it balanced. They are replacing one of the tires since there is a cut on the sidewall. Besides that it replace the axle shafts and bearing... I wish the rugged rocks axle shafts were on the market I would save about $400 by getting them. I will not sign anything and the shop doing the work gives a lifetime warranty on there labor. I will always go to them if I can't do it myself as of right now. The issue I'm working on a drill ship right now so I'm not on land to answer my phone everything is through email.

So I got an email from the repair shop that My X is fixed and ready to be picked up and the insurance check is sitting there for me too. YEAH. Now I just have to wait 10 more days till I get back in town to get it...
